New book: Analysis of the New Law for the National System of Socio-Educational Services in Brazil

My latest book (SINASE: comments on the Law 12.594/2012) will be in bookstores throughout Brazil. SINASE is the National System of Socio-Educational Services in Brazil. The comments are about the new guidelines, principles and rules of SINASE that organize and regulate the monitoring of compliance with educational measures, community services, probation, and detention of adolescents judicially determined to be in conflict with the law.

The goal of my book is to offer theoretical and practical advice on the structuring, establishment and development of activities relevant to the programs and plans for social and educational care.

To this end, the new regulations are considered in relation to the previous protective regulations established by the Regency laws concerning children and juveniles, i.e. the Constitution of 1988 and the Statute on Children and Adolescents.

The doctrine of full protection thus remains the guiding principle for the creation of legislation, for judicial application, for the implementation of care programs, and for the enactment of educational measures.

The National System of Socio-Educational Services (SINASE) is a bill that has been approved by resolution of the National Council for the Rights of the Child and Adolescent. SINASE standardizes the rules for legal proceedings involving minors, ranging from the investigation of infractions to the implementation of educational measures.

Among the new regulations is the requirement that each unit of care in a detention center holds no more than 90 teenagers at a time, and the rooms will be occupied by no more than three young people. Changes are also required in the architecture of these units, which must now focus on the horizontal construction and adequate space for physical activity.

Educational services, health, leisure, culture, sport and professionalism are priorities in the new system. The bill also specifies the responsibilities of federal, state and municipal governments regarding the implementation of the measures and social reintegration of adolescents who have come into conflict with the law.

Another requirement, for example, is that cities with more than 100,000 people must develop and implement plans for the fulfillment of outdoor educational measures in an open environment, such as community services. Municipalities are encouraged to develop consortia with each other and develop regional plans.

The Convention on the Rights of the Child was adopted by the United Nations General Assembly in 1989, as an important addition to the Universal Declaration of Human Rights.
